Your privacy is important to us. This privacy Notice explains our collection, use, and disclosure of personal data. This privacy Notice applies to Game Changers Film, LLC and to our controlled affiliates and subsidiaries (“The Game Changers”, “we”, “us”, or “our”). References to our “products” in this Notice include our websites and mobile or connected device apps or when you otherwise interact with us. This Notice applies to our products that display or reference this Notice, but it does not apply to any products that display or reference a different privacy Notice.

PERSONAL DATA WE COLLECT

The personal data we collect depends on how you interact with us, the products you use, and the choices you make. We collect and process personal data about you with your consent and/or as necessary to provide the products you use, operate our business, meet our contractual and legal obligations, protect the security of our systems and our customers, or fulfil other legitimate interests.

Sources of information you provide directly. We collect information about you in various ways when you use our products, such as when you purchase or view information about our products, register or use our mobile or connected device apps, take our surveys, participate in any promotion, interact with our social media presence, or in any other way. Examples of information you provide directly.

  • contact information: name, email address, postal address, phone number;
  • wellness information: dietary preferences;
  • payment information: credit card numbers and other payment card information (if you make a purchase); and
  • commercial information: products or services purchased, including shipping and delivery information and preferences and information related to returns, refunds, and cancellations.

Sources of information collected automatically. We automatically receive and store certain technical information about your device and systems you use to connect with and interact with us. For example, like many other websites, we use “cookies” placed on your devices to recognize your device and enhance your experience on our websites as described below. We may also automatically collect information about you through our mobile or connected device apps.

Examples of information collected automatically when you use our websites. As further described in the Cookies and Similar Technologies section below, when you use our products, some information is collected automatically, such as, but not limited to, these examples:

  • device identifiers: Internet Protocol (IP) address and cookie identifiers; and
  • device, system, and usage data: operating system, access times, browser type and language, the website you visited before our site, and your activity on our websites.

Examples of information collected when you use our mobile or connected device apps. When you download, install, first launch, or use our mobile or connected device apps, we may receive information about your device, including the location of your device, and may access your camera, microphone, or other device services or hardware. Some devices may allow you to opt-out of this collection or access, and in those cases, you may stop the collection or access. Please review your device settings for more information. Examples of mobile information we collect if you use our mobile or connected device apps or mobile sites includes without limitation the same data as we collect through our websites besides these examples:

  • mobile device data: device data (e.g., device hardware model), system (e.g., mobile operating system), usage data (i.e., information about your use of our mobile or connected device apps) and unique device identifiers.

Third-party sources. We also obtain information from third parties. We protect information obtained from third parties according to the practices described in this Notice, plus any additional restrictions imposed by the source of the information. These third-party sources include:

  • Data brokers from which we purchase demographic data to supplement the data we collect;
  • Applications and services, such as social networks, that make users’ information available to others;
  • Service providers that help us determine your device’s location based on its IP address to customize certain products to your location;
  • Partners with which we offer co-branded services or engage in joint marketing activities; and
  • Publicly available sources, such as open government databases or other data in the public domain.

When asked to provide personal data, you may decline. But if you choose not to provide information necessary for certain products or features, those products or features may not be available or function correctly.

COOKIES AND SIMILAR TECHNOLOGIES

We use cookies and similar technologies to operate our websites and online services and to help collect data. Cookies are small text files placed on your device to store data that can be recalled by a web server in the same domain that placed the cookie. The text in a cookie often consists of a string of numbers and letters that uniquely identifies your device, but it can contain other information.

We use cookies on our websites to store your preferences and settings, enable you to sign-in, provide interest-based advertising, combat fraud, analyze how our products perform, and fulfill other legitimate purposes.

Our web pages may also contain electronic images known as web beacons (also called single-pixel gifs) that we use to help deliver cookies on our websites, count users who have visited those websites, and gather usage and performance data. We also include web beacons in our promotional email messages or newsletters to determine whether you open and act on them.

Our websites may include web beacons and cookies from third-party service providers. Sometimes, that is because we have hired the third party to provide services on our behalf, such as site analytics. In other cases, it is because our web pages contain web beacons used to track interaction with and effectiveness of content (such as videos, news content) and ads from third parties. Because your browser connects to those third parties' web servers to retrieve that content, those third parties can set or read their own cookies on your device and may collect information about your online activities across websites or online services.

OUR USE OF PERSONAL DATA

We use personal data collected through our products for purposes described in this privacy Notice or otherwise disclosed to you. For example, we use personal data to:

  • provide and deliver our products, including payment, securing, troubleshooting, improving, and personalizing those products;
  • operate our business, such as improving our internal operations, securing our systems, and detecting fraudulent or illegal activity;
  • understand you and your preferences to enhance your experience and enjoyment using our products;
  • provide customer support and respond to your questions;
  • send you information, including confirmations, invoices, technical notices, updates, security alerts, and support and administrative messages;
  • communicate with you about new products, offers, promotions, rewards, contests, sweepstakes, surveys, upcoming events, and other about our products and those of our selected partners (see the Choice and Control section of this privacy Notice for how to change your preferences for promotional communications);
  • facilitate sweepstakes, contests and promotions and processing and delivering related entries and prizes; and
  • display advertising to you (see the Cookies section of this privacy Notice for information about your advertising choices)

In carrying out these purposes, we combine data we collect from different sources to give you a more seamless, consistent, and personalized experience.

OUR SHARING OF PERSONAL DATA

We share your personal data with third-parties (i.e. bank, payment processor or shipping company) under one of two conditions: (1) we have your consent to share your personal data; or (2) sharing your personal data is necessary to complete a specific purpose such as: (i) completing your transaction; (ii) purchasing a product from our online store; (iii) providing a requested service; (iv) taking an authorized action; (v) preventing fraud; (vi) reducing credit risk; or (vii) providing other services you have requested.

A common example of sharing your personal data occurs when you purchase a product from our online store. To complete your purchase, the payment processor you select will require additional personal information. This information may include bank or credit card information or other personal data the payment processor requires for completing the purchase. If not provided by you, directly to the payment processor, we will share this information to complete your purchase.

We offer the following payment processing services for purchasing products in our online store. Please note If you provide personal data to these third parties or consent to our sharing your personal data with them, that personal data is governed by their privacy Notices. Please review the privacy Notice for the payment processor you select when purchasing a product in our online store.


In addition, we share personal data among our affiliates and subsidiaries. We also share personal data with vendors or agents working on our behalf for the purposes described in this Notice. For example, companies we've hired to provide email delivery services or assist in protecting and securing our systems and services may need access to personal data to provide those functions. In such cases, these companies must abide by data privacy and security requirements and may not use personal data they receive from us for any other purpose. We may also disclose and transfer personal data as part of a corporate transaction such as a merger, transfer, divestiture, or sale of all or a portion of our business or assets.

Finally, we will access, transfer, disclose, and preserve personal data when we believe that doing so is necessary to:

  • comply with law or respond to valid legal process, including from law enforcement or other government agencies;
  • protect our customers, for example to prevent spam or attempts to defraud users of our products, or to help prevent the loss of life or serious injury of anyone;
  • operate and maintain the security of our products, including to prevent or stop an attack on our computer systems or networks; or
  • protect our rights or property, including enforcing our agreements.

Some of our products include references or links to products provided by third parties whose privacy practices differ from ours. If you provide personal data to those third parties (including payment processors), or consent to our sharing personal data with them, that data is governed by their privacy Notices.

We may share deidentified and aggregate data with third parties as permitted by law.

Information you may share while using our products. Our products may offer social sharing features and other integrated tools, such as the Instagram, Facebook, Twitter and Pinterest buttons (e.g., “Like,” “Tweet” and “Pin It”), which let you share actions you take on our products with other media. Your use of such features enables sharing information with your friends or the public, depending on the settings you establish with the entity that provides the social sharing feature. CHOICE AND CONTROL OF PERSONAL DATA

Access, correction, and deletion. If you wish to request access to, or correction or deletion of, personal data about you we hold, you may email us at [email protected]. If you cannot access certain personal data we collect via the links above or directly through the Game Changers products you use, you can always contact us as described at the bottom of this privacy Notice. However, to the extent permitted by law, we reserve the right to charge a fee or decline requests that are unreasonable, excessive, or prohibited by law, could hurt the privacy or other rights of another person, or where we cannot authenticate you as the person to whom the data relates.

Communications preferences. You can choose whether to receive promotional communications from us by email. If you receive promotional email from us and would like to stop, you can do so by following the directions in that message. You may also contact us at [email protected]..

Cookie controls. Most web browsers are set to accept cookies by default. If you prefer, you can set your browser to delete or reject cookies. Instructions for blocking or deleting cookies may be available in your browser's privacy or help documentation. If you delete or reject cookies, this could affect certain features or services of our website. If you delete cookies, settings and preferences controlled by those cookies, including advertising preferences, may be deleted and may need to be recreated. See the Cookies section of this privacy Notice for more details.

Advertising and analytics. Our third-party analytics and advertising partners typically provide options to opt-out of certain information collection or use. See the Cookies section of this privacy Notice for more details.

Do Not Track. Some browsers have incorporated "Do Not Track" (DNT) features that can send a signal to the websites you visit indicating you do not wish to be tracked. Because there is not a common understanding of how to interpret the DNT signal, our websites do not currently respond to browser DNT signals. Instead, you can use the range of other tools to control data collection and use, including the cookie controls and advertising controls described above.

EUROPEAN DATA PROTECTION RIGHTS

If the processing of personal data about you is subject to European Union data protection law, you have certain rights regarding that data:

  • You can request access to, and rectification or erasure of, personal data;
  • If any automated processing of personal data is based on your consent or a contract with you, you may transfer or receive a copy of your personal data in a usable and portable format;
  • If the processing of personal data is based on your consent, you can withdraw consent at any time for future processing;
  • You can object to, or obtain a restriction of, the processing of personal data under certain circumstances; and
  • For residents of France, you can send us specific instructions regarding the use of your data after your death.

To make such requests, contact us at [email protected]. When processing data on behalf of another party that is the “data controller,” you should direct your request to that party. You may also lodge a complaint with a supervisory authority, but we encourage you to first contact us with questions or concerns.

NOTICE TO CALIFORNIA RESIDENTS - YOUR CALIFORNIA PRIVACY RIGHTS AS PROVIDED BY CALIFORNIA CIVIL CODE § 1798.83

A California resident who has provided Personal Data, as defined under California Civil Code section 1798.83, to a business with whom the individual has established a business relationship for personal, family, or household purposes (a “California Customer”) may request information about whether the business has disclosed personal data to any third parties for the third parties’ direct marketing purposes. If the business has made such a disclosure of Personal Data, upon receipt of a request by a California Customer, the business must provide a list of all third parties to whom Personal Data was disclosed in the preceding calendar year, and a list of the categories of Personal Data that were disclosed. California Customers may request further information about our compliance with this law by e-mailing [email protected]. Please note that we are required to respond to one request per California Customer each year, and we are not required to respond to requests made by means other than through this e-mail address.

RETENTION OF PERSONAL DATA

We retain personal data for as long as necessary to provide the products and fulfill the transactions you have requested, or for other essential purposes such as complying with our legal obligations, resolving disputes, and enforcing our agreements. Because these needs can vary for different data types in the context of different products, actual retention periods can vary significantly based on criteria such as user expectations or consent, the sensitivity of the data, the availability of automated controls that enable users to delete data, and our legal or contractual obligations.

LOCATION OF PERSONAL DATA

We transfer personal data from the European Economic Area and Switzerland to other countries, some of which have not been determined by the European Commission to have an adequate level of data protection. When we do so, we use a variety of legal mechanisms, including contracts, to help ensure your rights and protections. SECURITY OF PERSONAL DATA

WWe take reasonable and appropriate steps to help protect personal data from unauthorized access, use, disclosure, alteration, and destruction.

To help us improve our data protection efforts we request that in instances where you need to use a password to use our products, you use a strong password, never share your password with anyone or use the same password with other sites or accounts, and notify us immediately if you suspect any misuse of your username or password.

CHANGES TO THIS PRIVACY STATEMENT

We will update this privacy Notice when necessary to reflect changes in our products, how we use personal data, or the applicable law. When we post changes to the Notice, we will change the "Last Updated" date at the top of the Notice. If we make material changes to the Notice, we will provide notice or obtain consent regarding such changes as may be required by law.
